These Terms of Service govern access to and use of the website and online store operated under the trading name The Companion Pets by RK1, a French simplified joint-stock company (SAS) with share capital of EUR 10,000, registered with the Paris Trade and Companies Register under number 978 537 553, VAT number FR15 978 537 553, whose registered office is at 22 rue Drouot, 75009 Paris, France (“The Companion Pets”, “we”, “us” or “our”).

By visiting or using our website or purchasing from us, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy. Mandatory consumer rights applicable in your country remain fully preserved.

1. Access and accounts

You must have the legal capacity required in your country to use our Services or place an order. You agree to provide accurate, complete and current information. You are responsible for safeguarding your account credentials and for activity carried out through your account. We may suspend access where reasonably necessary to protect customers, the website or our rights.

2. Products and information

We take reasonable care to present product descriptions, images, dimensions, colours and availability accurately. Displays and devices may render colours differently, and minor non-material variations may occur. We may update descriptions, prices or availability before an order is accepted. Products must be used in accordance with their instructions, warnings and intended purpose, and pets should be supervised where appropriate.

3. Orders

Submitting an order is an offer to purchase. An order becomes binding when we send confirmation that it has been accepted. We may refuse or cancel an order for legitimate reasons, including suspected fraud, pricing errors, stock unavailability, delivery restrictions or payment failure. If we cancel after payment, we will refund the amount charged. Please review your order and delivery details carefully before submission.

4. Prices, payment, taxes and import charges

Prices and available currencies are displayed at checkout. Applicable taxes and shipping charges, if any, are shown before payment. For international deliveries, customs duties, import taxes or brokerage charges may be payable by the recipient unless checkout expressly states otherwise. Payments are processed by the payment providers displayed at checkout. We do not store complete payment-card numbers.

5. Shipping, delivery and risk

Processing and estimated delivery times are described in our Shipping Policy. Delivery estimates are not guarantees and may be affected by carriers, customs or events outside our reasonable control. Risk of loss passes to you when you or a third party designated by you, other than the carrier, takes physical possession of the products, except where mandatory law provides otherwise. Please contact us promptly about a missing or materially delayed parcel.

6. Returns, cancellation and statutory guarantees

Returns, refunds and order cancellations are governed by our Refund Policy. Consumers retain all mandatory withdrawal rights and statutory conformity or hidden-defect guarantees that apply to them. Nothing in these Terms limits rights that cannot legally be waived.

7. Acceptable use

You may not use the Services for unlawful, fraudulent, abusive or harmful purposes; interfere with security or operation; introduce malware; scrape or copy the website at scale without permission; impersonate another person; infringe intellectual-property or privacy rights; or use the Services to resell products without our written consent. We may take proportionate action where these rules are breached.

8. Intellectual property

The website, brand elements, original copy, layout and other protected content are owned by or licensed to RK1. You may use the website for personal, non-commercial shopping purposes only. No licence is granted except as necessary to use the Services. Third-party names and marks remain the property of their respective owners.

9. Reviews and submitted content

If you submit a review, image or other content, you confirm that you have the right to do so and that it is accurate, lawful and does not infringe third-party rights. You grant us a non-exclusive, worldwide, royalty-free licence to display and adapt that content for operating and promoting the Services, subject to applicable privacy law. We may moderate content for legitimate reasons but do not manipulate reviews to create a misleading impression.

10. Third-party services and links

The Services may include payment, delivery, analytics, advertising, customer-support or other third-party tools and links. Their own terms and privacy practices may apply. We are not responsible for independent third-party websites, but this does not affect any responsibility we have for our own sale to you.

11. Shopify

Our store is powered by Shopify, which provides the commerce infrastructure used to deliver the Services. Purchases are made directly from The Companion Pets, not Shopify. Shopify is not the seller of our products and is not responsible for fulfilling our orders. Personal information may be processed by Shopify as described in our Privacy Policy and Shopify’s applicable privacy notices.

12. Availability, warranties and liability

We aim to keep the Services secure and available, but uninterrupted or error-free access cannot be guaranteed. To the fullest extent permitted by law, we are not liable for indirect or unforeseeable loss that is not caused by our breach. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. Please review it before using the Services.

14. Changes

We may update these Terms for legal, operational or service-related reasons. The version in force when an order is accepted governs that order, unless a mandatory rule requires otherwise. Material changes affecting registered users will be communicated where required by law.

15. Governing law and disputes

These Terms are governed by French law. If you are a consumer, you retain the protection of mandatory laws in your country of residence and may bring proceedings before any court having jurisdiction under applicable consumer law. Nothing in this clause deprives you of mandatory rights or remedies.

16. Severability and no waiver

If a provision is held invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of the right to enforce it later.
